The following are the privacy policies (“Agreement” or “Privacy Policies”) that shall be applicable to the use of the Codealike Software (“Software”) and its related website located at the URL www.codealike.com (“Website”).
WHEN YOU DOWNLOAD, ACCESS AND IN ANY WAY USE THE SOFTWARE OR SURF AND REGISTER WITH THE WEBSITE, YOU BECOME A LINCENSEE (“LICENSEE”) OF THE SOFTWARE AND ARE BOUND TO COMPLY AND RESPECT THE PRESENT PRIVACY POLICIES. BY ACCESSING, IN ANY WAY USING THE SOFTWARE OR BY SURFING THROUGH AND REGISTERING WITH THE WEBSITE YOU ARE ENTERING INTO A LEGALLY BINDING AGREEMENT WITH CODEALIKE S.A. (“CODEALIKE”), AN ARGENTINE LEGAL ENTITY DOMICILED AT AV. IGNACIO NUNEZ 6220, CIUDAD AUTONOMA DE BUENOS AIRES. IF YOU DO NOT AGREE WITH ANY OR ALL THE CLAUSES OF THIS AGREEMENT, DO NOT DOWNLOAD, ACCESS OR USE THE SOFTWARE OR REGISTER WITH THE WEBSITE.
I - Admission as UserAcceptance of the Privacy Policies
Codealike has structured a series of rules of use in the present Agreement in order to safeguard its Licensee’s privacy and personal data. In order to comply with its rules and privacy protection policies, every person that uses the Software or visits, registers or surfs through the Website, must unconditionally accept to be bound to the Agreement. As long as Licensees respect and comply with the obligations hereunder, Codealike grants them the revocable, non exclusive, limited and non assignable right to use the Software and access the services provided in the Website.
II - Information provided by LicenseesType of Information Used by Codealike
The Codealike Privacy Policies inform Licensees about how and why personal information is recollected through the Website to successfully use the Software. Codealike recognizes the importance of Licensees’ control of their personal data and these Privacy Policies shall help the latter make responsible decisions about their use of Codealike’s Software and Website.
Licensees provide two types of information to Codealike: (i) data that the Licensees provide during the registration process; (ii) usage and traffic data that is automatically generated by the mere use of the Software or Website; and (iii) status of payments made through third party websites.(i) Registration Information Voluntary Provision
When Licensees choose to register, they must provide the following personal data through the Website: full name, user name and email address. Codealike automatically creates a user account for each Licensee based on their subscriptions to popular social networking sites, including but not limited to Facebook, LinkedIn, Twitter, etc. Codealike does not require the provision of passwords or further personal data to complete Licensees’ registration. Licensees accept and acknowledge that Codealike does not administer, create, nor is in any way responsible for each Licensees’ accounts in the before-mentioned social networking sites and that they must review and agree to the Terms and Conditions and Privacy Policies available in each different website.
Licensees’ email addresses are in all cases private and shall not be published nor shared with other Licensees or any other third party. Therefore, Licensees acknowledge that the information is voluntarily provided and that he/she agrees to the uses and treatment of its personal data in accordance with the present Agreement.
Codealike shall not reveal these personal data to third parties and shall guard them in accordance to the present Agreement. In case of assignments of personal data, Codealike shall notify Licensees and shall offer them the possibility of cancelling their registration.User’s Obligations
To effectively register with Codealike, Licensees must provide a valid email account. Each Licensee’s registration is personal and their accounts cannot be subject to assignments. Therefore, Codealike does not allow multiple registrations by a single individual. Licensees are liable for false information provided to Codealike and are exclusively responsible for guarding the security of their social networking accounts.(ii) Usage and Traffic Data
When a Licensee uses the Software and Website, Codealike receives information such as: coding time, idle time, debugging time, building time, system time, among others. These types of usage data are retrieved in order to conduct the performance reports. Codealike does not retrieve, store or process codes used by Licensees during their use of the Software. Licensees authorize Codealike to use Licensees information to create statistical and anonymous reports for the purpose of studying and enhancing the Software and adapting it to Licensees’ future needs.
Codealike uses permanent cookies which are automatically downloaded to Licensees’ computer in order to remember user names other preferences. Cookies are exclusively downloaded to personalize Licensees’ experience. However, cookies are not mandatory to use the Software or Website and Licensees may eliminate or restrict them in their own operative systems.(iii) Status of Payments
Codealike has no access and does not construct data bases based on Licensees’ financial data provided during the payment of services or Software Licenses through PayPal or any other online payment systems. The use and process of financial data is conducted in accordance to PayPal’s or other websites own Privacy Policies. Codealike does not retrieve process, administer or file in any way Licensees’ financial data and only receives status of payments from PayPal or any other online payment systems available. Licensees agree to indemnify Codealike from any claims that might arise from damages or conflicts by and between them and PayPal or other online payment systems.
III. Licensees’ RightsRight to Access, Rectify and Suppress information
Licensees may access and control their accounts at any time by accessing the option “Account Settings”. Licensees may unsubscribe and terminate their accounts at any time and their information shall be from then on permanently inaccessible.
If Licensees need assistance to rectify and/or suppress any data that has been provided to Codealike, he/she may send an email to email@example.com. Codealike will contact the Licensee within a reasonable period of time the results of the query.
In case a Licensee believes that there could be an infringement of the Agreement or if he/she has any other claim, they may send an email to firstname.lastname@example.org.
IV. Codealike’s ObligationsA. Provision of services
As long as the Software and Website are operational, Codealike undertakes the obligation to constantly develop its services in order to improve the Licensees’ experiences.
Codealike has the exclusive right to suspend, replace, restrict, temporally or permanently discontinue the access to its services, with or without notice. Codealike does not guarantee the availability and operation of the website, but shall notify of interruptions and failures that may affect its use when the circumstances allow it.
In case of a violation to this Agreement Codealike shall suspend, replace, restrict or temporarily discontinue all or part of its services to all or some Licensees without prior notice. Codealike shall not be liable for any consequences of this cancellation.B. Security
Codealike shall make its best efforts to provide its Licensees with a secure platform and will use antivirus, firewalls and other technologies to prevent attacks. However, Codealike is not liable for possible attacks, phishing, pfarming or any other force majeur event that may breach the Software’s or Website’s security systems.
V - MiscellaneaA. Applicable Law
This Agreement and any disputes arising out of or relating to the Agreement shall be governed by the law of the Republic of Argentina, excluding any conflict of law rules.B. Jurisdiction
Any Disputes arising out of or in connection with this Agreement shall be resolved by the courts of the City of Buenos Aires, Argentina.C. Notifications
For all legal, judicial and extrajudicial effects, Codealike constitutes its legal domicile at AV. IGNACIO NUNEZ 6220, CIUDAD AUTONOMA DE BUENOS AIRES, ARGENTINA where all notifications concerning the site shall be valid.D. Severability
If any provision of this Agreement is found to be invalid or unenforceable under mandatory laws of a particular jurisdiction, such provision shall be interpreted as to give maximum effect to its intended purpose and this shall not affect the validity or enforceability of (a) such provision under the laws of any other jurisdiction, or (b) any other provision of this Agreement.E. Modification
Codealike reserves the right to modify, supplement or replace the Agreement, effective upon posting at www.codealike.com. Licensees acknowledge that should they persist in the use of the Software or its Website after the posting of the modifications, then they have implicitly accepted the new Agreement. Licensees have the obligation to visit the Terms and Conditions and this Agreement’s site to control if there have been any modifications.F. Language
Codealike provides its Licensees with versions of this Agreement in other languages. However, should there be any differences; the original and binding version shall be the Agreement in its English version.
